Terms and Conditions
Assumption of Risk:
I understand and acknowledge that there are dangers, hazards and risks of injury or illness, some of which are inherent in my use of (dependent on Class) kitchen appliances; mixers, processors, melting pots, and from crafting tools; glue guns, sewing machines, scissors, fabric cutters, (“Equipment”) or materials; paint, glue, decoupage, sealant, floral preservatives, (“Materials”) and at my presence at, or participation in, the Class, include but are not limited to potential for serious bodily injury, burns, cuts, accidents, illness, skin irritation, allergic reaction, equipment failure, inadequate safety measures, and other accidents or incidents that may result in injury or damage (“Risks”).
I understand that these Risks and dangers may be caused by own actions or inactions, the actions or inactions of others participating in the Class or related activities, the conditions in which the Class takes place, the conditions or set up of the premises of the Class (“Premises”) or through the NEGLIGENCE of the Class Instructor or any of the Released Parties (as defined below). I understand and acknowledge that there may be other risks or social and economic losses either known, not known, not known or not readily foreseeable at this time, and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR ALL LOSSES, COST AND DAMAGES that incur as a result of my participation in the Class.
I acknowledge and agree that if at any time I believe the conditions of the Class and related activities to be unsafe I will immediately discontinue any further participation in the Class or related activities or notify an Instructor of such conditions.
Release of Liability:
I hereby forever release and waive any and all rights, claims, and actions that I and my heirs, executors, administrators, and assigns may have, or that may hereafter accrue against Class Instructor, Antsy Nancy LLC, the Premises owners and managers, and all other persons, organizations, and other entities associated with the Class, and each of their respective parents, affiliates, officers, directors, partners, shareholders, members, agents, employees, and volunteers (“Released Parties”), of any kind or nature, which arise out of, result from, or relate to my use of, presence at, or participation in the Class, which may arise out of, result from, or relate to the ordinary negligence of the Released Parties.
Classes are developed using common cooking and baking ingredients that may or may not be specified in the menu titles, including various fruits and vegetables, nuts, meats, spices, wheat flours, etc. If you or your dependent have a food allergy, please check before attending the Class. Adjustments to recipes cannot be made during Class. FOOD is prepared in a kitchen that is not regulated or inspected by a REGULATORY AUTHORITY.
In the event of an illness, injury or medical emergency arising during the Class, I hereby authorize and give my consent to Class Instructor to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization and agree to indemnify and hold harmless the Released Parties from any liability associated with the treatment or related expenses.
Release for COVID-19:
According to the World Health Organization, COVID-19 disease is caused by the SARS-CoV-2 virus, which spreads between people in several different ways.
The virus can spread from an infected person’s mouth or nose in small liquid particles when they cough, sneeze, speak, sing, or breathe. These particles range from larger respiratory droplets to smaller aerosols.
- Current evidence suggests that the virus spreads mainly between people who are in close contact with each other, typically within 1 metre (short-range). A person can be infected when aerosols or droplets containing the virus are inhaled or come directly into contact with the eyes, nose, or mouth.
- The virus can also spread in poorly ventilated and/or crowded indoor settings, where people tend to spend longer periods of time. This is because aerosols remain suspended in the air or travel farther than 1 metre (long-range).
People may also become infected by touching surfaces that have been contaminated by the virus when touching their eyes, nose, or mouth without cleaning their hands.
Antsy Nancy takes precautions to stop the spread of COVID-19, including cleaning/bleaching all workspaces, tools, and touchpoints between every class. Every customer is required to wash their hands upon entry to the store.
If customers are not vaccinated, we recommend wearing masks.
If you, as customer are sick, not feeling well, or showing any symptoms of COVID-19, you are prohibited from attending Antsy Nancy in-person class. Please contact us immediately upon experiencing symptoms and we will either reschedule your class, make arrangement for you to take class online, or reimburse your class, if you are within the cancellation timeline.
Antsy Nancy will follow all city and state guidelines and rules regarding social distancing and mask mandates and customers will be required to follow those rules also. If a customer refuses, they may opt to take the class online, or cancel class for reimbursement, if within the cancellation timeline.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending a Class and that such exposure or infection may result in personal illness, and possible death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Class may result from the actions, omissions, or negligence of myself and others, including, but not limited to Antsy Nancy employees, volunteers, and other customers.
Release for Personal Likeness:
By entering the Premises and participating in the Class, I understand that the Class Instructor, Antsy Nancy LLC, and their affiliates, agents, representatives, and assigns may take photographs and/or video during class of participants and/or their work. I also understand that an online Class may run simultaneous with in-person Class. Although Instructor will be on camera focus, any area of the Class may be broadcast to the Online Class and Recorded for future use. I grant to Class Instructor, Antsy Nancy LLC, and their successors, assigns and licensees my irrevocable consent to include my photographic image and voice in various Class lessons, marketing materials, including but not limited to social media, websites, flyers, posters, and other promotional materials. All photographs, film or video footage, or other audio or video recordings of the Class and its participants, and any works derived therefrom, shall be the sole property of Antsy Nancy LLC, or their assigns, as applicable, and you waive any and all right of publicity, privacy or other rights therein. If you do not wish to be photographed or recorded, you should let the Instructor know upon arrival to the Class.
Online Waiver and Media Release:
I understand that by turning on my electronic device’s camera during an Online Class, it will broadcast to the Instructor and class participants. I consent to and allow any reproduction of any, and all, photographs or video recordings taken of myself or member of my household during our participation in the Online Class. I agree to Antsy Nancy’s right to use or reproduce such photographs and video recordings in any media, including social media or online.
As the Parent and/or Legal Guardian to the minor participant of the Class, I hereby accept and agree to all the terms and conditions in connection with the minor’s participation in the Class.
